I. General Terms

  • Regulations - these regulations
  • Service - the "upbrand.pl" online service operating under the address https://upbrand.pl
  • Service Provider - the company "Upbrand Paweł Ławniczak" with its registered office at: ul. Basztowa 2/4 58-316 Wałbrzych NIP: 8862881882,
  • Service Recipient - any natural person accessing the Service and using the services provided through the Service by the Service Provider.
  • Electronic Communication - Communication between the parties via email and contact forms available on the website.

II. General Provisions

  • These regulations define the principles of operation and use of the Service and the scope of rights and obligations of the Service Recipients and the Service Provider related to the use of the Service.
  • The subject of the Service Provider’s services is to provide free tools in the form of the Service enabling Service Recipients to access content in the form of article entries, audiovisual materials, internet applications, and electronic forms.
  • Any articles and information containing guidelines or advice published on the Service are general collections of information and are not directed to individual Service Recipients. The Service Provider is not responsible for their use by the Service Recipients.
  • The Service Recipient assumes full responsibility for the manner of using the materials made available within the Service, including for their use in accordance with applicable laws.
  • The Service Provider does not guarantee the usefulness of the materials placed in the Service.
  • The Service Provider is not liable for any damages incurred by the Service Recipients or third parties in connection with the use of the Service. All risks related to the use of the Service, particularly with the use and application of information placed in the Service, are borne by the Service Recipient using the services of the Service.

III. Terms of Use of the Service

  • The use of the Service by any Service Recipient is free and voluntary.
  • Service Recipients are required to read the Regulations and other documents constituting its integral part and must accept its provisions in full to continue using the Service.
  • Service Recipients may not use any personal data obtained in the Service for marketing purposes.
  • Technical Requirements for Using the Service:
    • A device with a display enabling the display of web pages,
    • Internet connection,
    • Any web browser that displays web pages according to W3C standards and provisions and supports web pages provided in HTML5,
    • JavaScript enabled,
    • Cookies enabled
  • To ensure the safety of the Service Provider, Service Recipients, and other users of the Service, all Service Recipients should follow generally accepted network security principles.,
  • Prohibited actions performed personally by the Service Recipients or using software:
    • Decompiling and analyzing the source code without written consent,
    • Causing excessive load on the Service server without written consent,
    • Attempting to detect security vulnerabilities of the Service and server configuration without written consent,
    • Uploading or injecting scripts and software on the server and database that may damage the Service software, other Service Recipients, or the Service Provider,
    • Uploading or injecting scripts and software on the server and database that may monitor or steal data from Service Recipients or the Service Provider,
    • Taking any actions aimed at damaging, blocking the operation of the Service, or preventing the Service from achieving its purpose.
  • In the event of detecting the occurrence or potential occurrence of a cybersecurity incident or GDPR violation, Service Recipients should report this fact to the Service Provider as soon as possible to promptly resolve the issue/threat and protect the interests of all Service Recipients of the Service.

IV. Newsletter Service Conditions

  • Service Recipients can use the Service without subscribing to the Newsletter.
  • Subscribing to the Newsletter service is voluntary and free of charge.
  • Technical Requirements for the Newsletter Service:
    • Having an individual email account,
  • Conditions for the Newsletter Service:
    • Providing an individual email account in the electronic form,
    • Verifying the provided email account by activating the link sent to it,
    • Agreeing to receive email notifications,
  • Scope of the Newsletter Service:
    • Notifying about new updates, posts, contests, and other promotional actions related to the Service’s offerings
    • Notifying about promotional actions by the Service's partners (Marketing Messages)
  • Unsubscribing from the Newsletter Service:
    • Any Service Recipient subscribed to the Newsletter service can independently unsubscribe from the service.
    • Service Recipients can do this through the link provided in each sent email.
    • Unsubscribing from the Newsletter service results in the removal of the provided email address from the Service Provider’s database.

V. Conditions for Communication and Provision of Other Services in the Service

  • The Service provides services and tools enabling Service Recipients to interact with the Service in the form of:
    • Contact form
    • Publishing own content in the form of posts and articles
    • Publishing own content in the form of graphic and multimedia materials
  • The Service provides contact details in the form of:
    • Email address
    • Contact phone number
  • In case of contact with the Service Provider, Service Recipients' personal data will be processed in accordance with the "Privacy Policy," which is an integral part of the Regulations.
  • Conditions for Publishing Content by Service Recipients in the Service:
    • It is prohibited to post offensive or defamatory content against the Service Provider, other Service Recipients, third parties, and entities,
    • It is prohibited to post text, graphic, audiovisual materials, scripts, programs, and other works for which the Service Recipient does not hold a license or for which the author of the economic rights has not consented to free publication,
    • It is prohibited to post vulgar, pornographic, erotic content, and content inconsistent with Polish and European law, as well as links to sites containing the indicated content,
    • It is prohibited to post scripts and programs that excessively load the server, illegal software, software used to violate security, and other similar actions, as well as links to sites containing the indicated materials,
    • It is prohibited to post marketing content and advertising other commercial services, products, services, or commercial websites.

VI. Collecting Data about Service Recipients

To provide services correctly, protect the legal interest of the Service Provider, and ensure the compliance of the Service with applicable law, the Service Provider, through the Service, collects and processes some data about the Users.

To provide services correctly, the Service uses and stores some anonymous information about the Service Recipient in cookies.

Scope, Purpose, Method, and Principles of Data Processing - these are available in the appendices to the Regulations: "Cookies Policy" and "Privacy Policy," which are an integral part of the Regulations.

  • DAutomatically Collected Data: To ensure the smooth operation of the Service and for statistics, some data about the Service Recipient is collected automatically. This includes:
    • IP address
    • Browser type
    • Screen resolution
    • Approximate location
    • Opened subpages of the service
    • Time spent on a specific subpage of the service
    • Type of operating system
    • Address of the previous subpage
    • Referring page address
    • Browser language
    • Internet connection speed
    • Internet service provider
    • Anonymous demographic data based on Google Analytics: gender, age and interests
    • Anonymous data necessary for serving ads: data related to remarketing and data related to ad display reporting

These data are obtained via Google Analytics script and are anonymous.

VII. Copyright

  • The owner of the Service and the copyright to the Service is the Service Provider.
  • Some data posted on the Service are protected by copyrights belonging to companies, institutions, and third parties not affiliated with the Service Provider and are used under licenses or based on a free license.
  • Under the Act of February 4, 1994, on copyright, it is prohibited to use, copy, reproduce in any form, and store in search systems, excluding Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook, and LinkedIn search engines, any articles, descriptions, photos, and all other content, graphic materials, videos, or audio found in the Service without written consent or consent communicated via Electronic Communication from their legal owner.
  • According to the Act of February 4, 1994, on copyright, simple press information understood as information alone without commentary and evaluation of its author is not subject to protection. The author understands this as the possibility of using information from the texts posted on the service but not copying the whole or parts of the articles unless indicated in the individual material provided in the Service.

VIII. Changes to the Regulations

  • Any provisions of the Regulations may be unilaterally changed by the Service Provider at any time without providing reasons.
  • Changes to the Regulations take effect immediately upon their publication.
  • It is considered that any Service Recipient continuing to use the Service after the change of the Regulations accepts them in full.

IX. Final Provisions

  • The Service Provider is not liable in any way to the fullest extent permitted by applicable law for content transmitted and published in the Service by Service Recipients for their truthfulness, reliability, authenticity, or legal defects.
  • The Service Provider will make every effort to ensure that the services of the Service are offered continuously. However, the Service Provider is not liable for disruptions caused by force majeure, unauthorized interference by Service Recipients, third parties, or external automatic programs.
  • The Service Provider reserves the right to change any information posted on the Service at a time chosen by the Service Provider without prior notification of Service Recipients using the Service’s services.
  • The Service Provider reserves the right to temporarily, completely, or partially shut down the Service for improvement, adding services, or maintenance without prior notification of Service Recipients.
  • The Service Provider reserves the right to permanently shut down the Service without prior notification of Service Recipients.
  • The Service Provider reserves the right to transfer in whole or in part all its rights and obligations related to the Service without the consent and the possibility of expressing any objections by the Service Recipients.
